«La Plagne Smile» (hereinafter «La Plagne Smile») is a programme offered by the Société d’Aménagement de la station de La Plagne (The Resort of la Plagne Operating Company) (hereinafter the «SAP»). It allows the member (hereinafter the «Member») to benefit from various advantages: free access to certain facilities offered by the SAP, promotional offers, invitation to events, etc. In joining La Plagne Smile, the Member accepts unreservedly these membership conditions (hereinafter the «Membership Conditions»).
ARTICLE 1. INFORMATION RELATING TO THE SAP
The SAP is a public limited company under French law with a share capital of 2,157,776.00 €, registered at the business and company registry in Chambéry under number 076 220 011, and of which the intra-community VAT number is: FR 05 076 220 011.

It is registered as an intermediary insurance agent under Orias number 18005294.
ARTICLE 2. BECOMING A MEMBER
The Member may join La Plagne Smile:
- Either when making a purchase on the SAP web site at the following address: https://www.skipass-laplagne.com (hereinafter the «Web Site»). To this end, the Member must enter all the information requested on the personalisation page of their personal account (e-mail address, password, forename, surname, date of birth, language, telephone number, full address, whether or not they own property in the resort and, if so, where). Membership is registered as soon as the Member enters the afore-mentioned information. The Member will then receive an e-mail confirming their membership sent to the e-mail address which they have entered into their personal account.
- Or when making a purchase in an SAP sales point.
To this end, the Member must provide the sales assistant with their forename, surname, date of birth and mobile telephone number. They will then receive a text message on the number supplied, which will contain a hypertext link enabling the Member to set up their personal account. The Member must then enter all the information requested when personalising their personal account (e-mail address, password, forename, surname, date of birth, language, telephone number, full address, whether or not they own property in the resort and, if so, where). Membership is registered as soon as the Member enters the afore-mentioned information. They will then receive an e-mail confirming their membership sent to the e-mail address they have entered into their personal account.
ARTICLE 3. FREE MEMBERSHIP
Membership is free.
ARTICLE 4. DURATION OF MEMBERSHIP
Membership is valid for an indefinite period.
The Member may terminate their membership at any time. To do this, they must notify the SAP at the address shown in article 7. Membership will end within a maximum of five working days from receipt by the SAP of the Member’s message.
The SAP reserves the option of terminating La Plagne Smile at any time. Membership will then end by right on the date established by the SAP, without the Member being entitled to any compensation whatsoever.
ARTICLE 5. MEMBERSHIP BENEFITS
The benefits of membership are outlined on the Web Site.
ARTICLE 6. PERSONAL DATA
6.1. Purpose of processing personal data
The personal data collected when the Member joins are processed in order to:
- Send the Member information about the benefits of La Plagne Smile;
- Ensure the Member enjoys the benefits of La Plagne Smile;
- Respond to requests for information, comments and complaints from the Member.
6.2. Basis of processing personal data
The processing mentioned in article 6.1 is based on the Member’s consent.
6.3. Responsibility for processing
The processing mentioned in article 6.1 is carried out under the responsibility of the SAP, represented by its managing director and the contact details of which are shown in article 1.
6.4. Recipients of the personal data
The data collected are destined for the SAP and service providers whose involvement is necessary to carry out the processing mentioned in article 6.1.
These data may be transferred to a country which is not a member of the European Union. The Member may obtain information about this transfer and the guarantees applicable to it from the SAP.
6.5. Duration of the retention of personal data.
The data collected are retained for the duration of membership.
6.6. Member’s rights
The Member may access data which concerns them, have them corrected or deleted, transfer them or have them transferred to a third party, have the processing limited or object to it. They may also withdraw their consent to the processing of their data, which will not, however, affect the legality of the processing carried out before the withdrawal of consent. To exercise these rights, they must submit a request to the data protection delegate at the SAP, at the address shown in article 7.
The SAP will comply with this request subject to compliance with the obligations imposed on it. To protect personal data, the SAP reserves the option to request proof of identity from the person lodging the request before responding to it.
Lastly, the Member may lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (National Commission for Digital Data and Freedom of Information (CNIL) if they consider their rights to have been infringed. The Member may also add their name free of charge to the list those not wishing to receive marketing telephone calls on the web site https://www.bloctel.gouv.fr.
ARTICLE 7. REQUESTS AND COMPLAINTS
The Member may submit any request or complaint concerning the processing of their personal data:

ARTICLE 8. SETTLEMENT OF DISPUTES
In the event of a dispute between the Member and the SAP relating to the validity, interpretation or application of the Membership Conditions, the Member may have recourse, free of charge, to a conventional mediation procedure or any alternative means of settling disputes.
They may have recourse to a mediation procedure with the Médiateur du Tourisme et du Voyage (Tourism and Travel Mediator) MTV Médiation Tourisme Voyage, BP 80 303, 75 823 Paris Cedex 17, France – Tel.: +33 (0)1 42 67 96 68 – E-mail: info@mtv.travel) in accordance with the terms established on the web site https://www.mtv.travel within a maximum of one year from the written complaint being lodged with the SAP.
They may also have recourse to the on-line dispute settlement platform set up by the European Commission, accessible on the web site https://webgate.ec.europa.eu/odr/.
Should an amicable settlement not be reached, the Member may take legal action either through one of the courts within whose jurisdiction the matter falls in accordance with the French code of civil actions or where they were resident at the time the contract was concluded or the event giving rise to the complaint took place.
ARTICLE 9. COMING INTO FORCE OF THE MEMBERSHIP CONDITIONS
The Membership Conditions apply to any membership taken out with effect from 15 November 2023.
They replace all membership conditions previously published.
ARTICLE 10. ALTERATION TO MEMBERSHIP CONDITIONS
The SAP reserves the option to modify the Membership Conditions at any time.
The Member will be notified of the alterations made to the Membership Conditions by e-mail one month before they come into force.
Should the Member not accept these alterations, they must notify their decision to cancel their membership in accordance with article 4.
If the Member does not cancel their membership, they will be deemed to have accepted the alterations.
ARTICLE 11. TRANSLATION OF THE MEMBERSHIP CONDITIONS
In the event of a contradiction between the Membership Conditions in French and the Membership Conditions in another language, the Membership Conditions in French will prevail.
ARTICLE 12. APPLICABLE LAW
The Membership Conditions are regulated by French law.
